Terms of Service
These Terms govern your use of Condor Vision, a service operated by Chicha Technology LLC ("we", "us"). By creating an account or using the service, you agree to these Terms.
1. The Service
Condor Vision is a cloud visual monitoring platform: you upload camera frames, we run AI analysis, store frames within your plan's retention window, and deliver alerts via webhook or email when watch conditions you configure are met.
2. Eligibility & Accounts
- You must be at least 18 years old or have legal authority to enter contracts.
- You are responsible for keeping your API keys and login credentials secure. Notify us immediately at security@condorbox.ai if you suspect compromise.
- One person or organization per account; sharing keys with third parties outside your organization is prohibited.
3. Subscription & Billing
Paid plans (Plus, Pro) are billed monthly through Stripe. Charges renew automatically until you cancel. You can cancel any time from the dashboard; cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for partial months. Free-tier accounts have no billing.
4. Acceptable Use
You agree not to:
- Use the service to record people without consent where consent is required by law.
- Enable the per-camera microphone in any location or context where doing so would violate a two-party (all-party) consent law, eavesdropping statute, or analogous foreign-law obligation. Audio recording is opt-in and you alone are responsible for obtaining the consent of every recorded party.
- Upload illegal content, including child sexual abuse material (CSAM).
- Reverse-engineer the service, scrape it at abusive rates, or attempt to circumvent quotas, rate limits, or authentication.
- Resell the service without a written reseller agreement.
We may suspend or terminate accounts that violate this section, with or without notice depending on severity.
5. Your Content
You retain ownership of camera frames, audio (when the mic is enabled), and metadata you upload. You grant us a limited license to store, process, and analyze them solely to deliver the service. We do not use your content to train AI models. Camera frames and audio are deleted automatically when the retention window expires, when you disable the mic, or when the camera is removed. 6. Service Limits & Fair Use
Plan limits — cameras, retention days, AI credits per month, storage cap,
and watches per camera — are listed at
/pricing. We never
auto-charge for usage above plan limits. When you reach a hard
cap (e.g. AI credits exhausted) the API returns an HTTP 402
for the call that would exceed it; you continue using everything else
until the next billing cycle or until you upgrade. Cameras keep
uploading and motion-gating keeps working — only the metered action is
blocked.
The API is rate-limited per key (default: 120 requests/minute) and per camera (frames-per-second cap from the plan). Sustained abuse, spamming, or misconfigured agents that bypass the rate limit may result in throttling or suspension. Throttling is not a billing event: you are never charged for blocked or throttled requests.
7. Availability
We aim for high availability but do not guarantee uninterrupted service. Maintenance windows, third-party outages (GCP, Stripe, Gemini, Google Workspace), and unforeseen incidents may cause downtime. There is no formal SLA on free plans.
8. Disclaimers
The service is provided "AS IS" without warranties of any kind. AI analysis is probabilistic and may produce false positives or false negatives. Do not rely on Condor Vision as the sole safety mechanism for life-critical applications (medical monitoring, fire detection, intrusion response). Always pair with professionally rated systems where required by law or risk.
9. Limitation of Liability
To the maximum extent permitted by law, Chicha Technology LLC's aggregate liability under these Terms is limited to the amount you paid us in the 12 months prior to the event giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.
10. Termination
You may close your account at any time. We may terminate accounts for violation of these Terms, prolonged non-payment, or as required by law. On termination, data is deleted per the Privacy Policy retention schedule.
11. Changes to These Terms
We may update these Terms. Material changes will be communicated via email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware.
13. Children Under 13
You must be at least 13 years old to use this service. Condor Vision is not directed at children under 13. If you are under 13, do not create an account or submit any information to us. We will delete any account we determine belongs to a child under 13 without notice. This policy is consistent with COPPA.
14. Healthcare and HIPAA
Condor Vision is NOT a HIPAA-eligible service. We do not sign Business Associate Agreements (BAAs). You agree not to use Condor Vision to process Protected Health Information (PHI) as defined under HIPAA. Do not point cameras at medical settings, exam rooms, patient areas, or anywhere PHI may be captured. Use of Condor Vision for PHI processing is a material breach of these Terms and may result in immediate account termination.
15. Biometric Disclosure
The optional edge agent uses on-device OpenCV classifiers for motion and face
detection. Face-detection events do not capture or transmit biometric identifiers
(face geometry templates). If you are subject to Illinois BIPA, Texas CUBI, or
Washington State biometric privacy law, you are responsible for obtaining any
required consent from individuals whose presence may be detected by your cameras,
and for disabling face detection if required by applicable law
(CONDOR_EDGE_FACE_DETECTION=false). We provide the technical controls;
compliance with local biometric laws is your responsibility as the camera operator.
16. Payment Processor and Sub-processors
Stripe is the data processor for all payment transactions. Stripe's Data Processing Agreement is available at stripe.com/dpa. We do not store or have access to your full payment card details.
Google Cloud Platform and Google Gemini are sub-processors used to host the service and perform AI vision analysis, respectively. Data shared with these sub-processors is governed by Google's sub-processor terms and our Data Processing Addendum (available on request).
